The petitioner, in the present case, is seeking regular bail in connection with Muffasil P.S. Case No. 78 of 2017 registered under Sections 414, 399, 402 and 401 of the Indian Penal Code.

Learned counsel for the petitioner submits that from the First Information Report it would appear that the petitioner was allegedly arrested by the police party on suspicion that he had assembled along with other accused and was planning to commit a crime. Learned counsel submits that the seizure list shows the recovery of one master key, one screwdriver, one mobile and one

Learned counsel for the petitioner further submits that almost similarly situated accused has been granted privilege of bail by this court today in Criminal Miscellaneous No. 27801 of 2017. The petitioner has no criminal antecedent and he is in custody since 20.02.2017.

Considering the nature of the allegation, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Samastipur in connection with Muffasil P.S. Case No, 78 of 2017 Subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
