The petitioner, who is in custody, seeks bail in connection with Masaurhi P.S. Case No. 409/2017 registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 27 of Arms Act.
There is direct allegation against petitioner of causing firearm injury on the head of deceased. As such, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected. The trial court is directed to expedite the trial and conclude the same within one year from date of receipt of copy
Patna High Court Cr.Misc. No.41150 of 2018(5) dt.18-09-2018 2/2 of this order. However, if the trial is not concluded within one year, the petitioner would be at liberty to renew his prayer for bail.
