The petitioner seeks bail in a case registered under Section 379 of the Indian Penal Code.

The prosecution case, in short, is that unknown miscreants stolen away motorcycle of the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.4.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. The petitioner was apprehended as pillion rider on stolen motorcycle. The petitioner had no knowledge that the motorcycle in question is stolen property and for the said reason he has been remanded in the present case. The case

Patna High Court CR. MISC. No.39726 of 2019(2) dt.28-06-2019 2/2 is triable by the Magistrate.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with K. Hat P.S. case No.150 of 2019.
