JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-06-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Complaint Case No. 810 (C) of 2011 registered for the offence under Sections-406/34 of the Indian Penal Code. The accusation against the petitioners is that they took Rs 46,000,00/- (forty six lacs) from the complainant but later on, they refused to return the aforesaid amount.
The contention on behalf of the petitioners is that there is nothing on the record to show that petitioners had taken the said
Patna High Court Cr.Misc. No.48349 of 2014 (3) dt.22-06-2015 2/2 amount from the complainant.
Considering the facts and circumstances of the case as well as submission of the parties, let the petitioners named above, in the event of their arrest or surrender within four weeks from the date of receipt/production of copy of the order in the court below, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Tr. No. 1641 of 2014 arising out of Complaint Case No. 810 (C) of 2011 to the satisfaction of Learned Chief Judicial Magistrate, Buxar.
