The petitioners seek bail in Rajauli P.S. case No. 72 of 2017 under Section 406, 420, 379, 120B/34 of the Indian Penal Code.

The petitioners are driver and cleaner of the tanker which was carrying milk. The allegation is that accused persons were committing theft of milk by filling the same in drums in collusion with the petitioners.

The learned counsel for the petitioner submits that no shortage of milk was found in the tanker. Other accused persons have already been enlarged on bail. The petitioners are in custody since 15.04.2017.

No.28121 of 2017 (2) dt.04-07-2017 2/2 Considering the facts aforesaid and the nature of allegation made against the petitioners and the fact that petitioners are in custody since 15.04.2017, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in Rajauli P.S. Case No. 72 of 2017.
