2 This application has been filed on behalf of the petitioner for grant of anticipatory bail, who is apprehending his arrest in connection with Sahayak Khazanchi PS Case No 218 of 2024 dated 20.09.2024 registered for the offence punishable under Section 7 (3) of the Lotteries (Regulation) Act, 1998. 3 The allegation is that in the raid, Md Mahfooz Alam and Md Aftab Alam were apprehended by the police selling lottery tickets. The FIR further contains that they disclosed the name of the petitioner as supplier.

4 The learned counsel for the petitioners submits that the petitioner has not been apprehended. His name transpired

Patna High Court CR. MISC. No.43570 of 2026(2) dt.17-07-2026 2/2 on the basis of so-called disclosure made before the police by the persons who were apprehended.

5 The learned counsel for the State vehemently opposed the prayer for bail.

6 Having considered the rival submissions and the fact that the petitioner's name transpired in the so-called disclosure made before the police, I am inclined to grant anticipatory bail to the petitioners.

7 Let the petitioner above named, in the event of his arrest/surrender within a period of four weeks from today, be released on bail on his furnishing bonds of Rs 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned CJM/Successor Court, Purnea in Sahayak Khazanchi PS Case No 218 of 2024 subject to all conditions as laid down under Section 482 (2) of the BNSS. 8 This application is allowed.
