The petitioners have preferred this application for grant of regular bail in a case registered under section 379 of the Indian Penal Code.

As per the prosecution case, the motorcycle of the informant was stolen when it was parked.

It is submitted by learned counsel for the petitioners that the FIR was registered against unknown. Referring to the order of the learned court below, it is submitted that only material against the petitioners is that the alleged motorcycle was recovered from the petitioners possession. Contrary to the allegation the same is incorrect. No incriminating article has

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioners being in custody for more than 10 months and both of them not having any criminal antecedent, the petitioners are directed to be enlarged on bail in connection with Siwan Muffasil P.S. Case no. 187 of 2021 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 4th, Siwan.
