Learned counsel for the petitioner is directed to remove the defects within four weeks.

Petitioner apprehends his arrest in a case registered for offence punishable u/s 332, 333, 353, 172, 174A, 414, 325/34, 33 of the IPC. Learned counsel for the petitioner seeks permission to delete the paragraph 10 of the bail application.

Permission is granted.

Allegedly, the accused persons named in F.I.R. including the petitioner tried to escape seeing the police personnel. All the alleged accused tried to flee away but three people were apprehended and one succeeded to flee away. Apprehended accused confessed that they are criminals and had committed loot-pat in bank and are involved in criminal activities.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has

The petitioner has been made escape goat to save the real culprits. The name of the petitioner has transpired in this case on the confessional statement of the apprehended accused. No incriminating article has been recovered from the conscious physical possession of the petitioner. There is no specific allegation against the petitioner. It is further submitted that all the sections are triable before the learned Magistrate except section 333 of the IPC. Petitioner has four criminal antecedents.

Learned APP for the State opposed the prayer for bail. Having regard to the facts and circumstances of the case, since there is no injury report, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Lalganj P.S. Case No.354 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
