2. In this case, the petitioner is seeking regular bail in connection with Gaighat P.S. Case No. 458 of 2023, registered for the offences punishable under Sections 363 and 365 of the IPC and later on, sections 302, 201, 120(B)/34 of the IPC was added.

3. The informant alleged in her fardbeyan that she was living in her Maika and her husband came there on 25.11.2023 at about 7:00 PM. It is further alleged that her husband went somewhere while talking on phone and he did not return.

4. The learned counsel for the petitioner has

He has submitted further that during investigation, it was detected that the informant, who is wife of the deceased, had illicit relation with someone else, which is the motive for commission of murder of the deceased. The petitioner is mother of the informant and she is an old lady, having no concern with the alleged occurrence. She is under custody since 03.12.2023.

5. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, East Muzaffarpur in connection with Gaighat P.S. Case No. 458 of 2023, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
