The petitioner being husband of the victim is apprehending arrest in a case registered for the offences punishable under sections 304B/34 of the Indian Penal Code. The accusation is of killing the sister of the informant for non fulfillment of dowry demands. It is submitted by the learned counsel for the petitioner that as per own admission of the informant in the FIR the marriage was performed eight years prior to the death of the victim, hence the case does not come under the purview of section 304B IPC. More over, the informant has retracted from the initial version by filing a petition before learned court below to the effect that actually the victim committed suicide.
The aforesaid facts constitute ground for
Patna High Court Cr.Misc. No.31544 of 2015 (2) dt.03-08-2015 2/2 consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Dalsinghsarai P.S. Case No. 317 of 2012 pending in the court of learned ACJM, Dalsinghsarai. This application is disposed of with the aforesaid observation/direction.
