2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 448, 341, 323, 307, 379, 504 and 506 of the Indian Penal Code.

3. As prosecution case, the allegation against the petitioner no. 1 is that he assaulted the informant sister-in-law Seema Devi and injury was found simple in nature which is enclosed in case diary. The allegation against petitioner no. 2 is that he had torn the blouse of informant sister-in-law (Lalita Devi) and also assaulted.

4. It is submitted by learned counsel for the petitioners

Patna High Court CR. MISC. No.49590 of 2023(4) dt.16-10-2023 2/2 that petitioners have falsely been implicated in this case. Petitioner no. 1 has one criminal antecedent whereas petitioner no. 2 has two criminal antecedents mentioned in Para 3 of the bail petition. He further submits that all the injury are found to be simple in nature and there is case and counter case between the parties.

5. Learned APP for the State opposes prayer for anticipatory bail.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Barauni (Refinary o.p.) P.S. Case No. 172 of 2023, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
