JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-09-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offence under Section 272, 273 of the IPC and u/s 30(a) of Bihar Prohibition and Excise Act. Total 20 liters of country made liquor has been recovered and it is alleged that recovery has been made from the motor cycle of this petitioner.
Petitioner denies the allegation and submits that he is neither owner of the motor cycle nor he has got any concern with the seized liquor. Petitioner has got clean antecedent. Considering the aforesaid facts and circumstances, let the above-named petitioner, in the event of his arrest / surrender before the court below within a period of six weeks from the date of receipt/production of copy of this order, be enlarged on
Patna High Court CR. MISC. No.41176 of 2022(2) dt.30-09-2022 2/2 provisional anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cumSpecial Judge, Excise Act, Jamui in connection with Laxmipur P.S. Case No. 308 of 2017, subject to condition as laid down under Section 438 (2) of the Cr.P.C. Subject to further condition that the ownership of the said motor cycle be duly verified by the court below and, if it is found that petitioner is not the owner of said motor cycle, the provisional anticipatory bail, granted to him, shall be confirmed. If, it is found that the ownership of said motor cycle is in the name of this petitioner, the court below would be at liberty to cancel the bail-bonds of the petitioner.
