JUSTICE ARUN KUMAR ORAL ORDER 05-07-2017 Heard learned counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Rail Thana (G.R.P.) Jamalpur Case No.36 of 2008 registered under Sections 341, 342, 323, 353, 307/34 and 302 of the Indian Penal Code. Learned counsel for the petitioner submits that earlier the prayer for bail of the petitioner was rejected by this Court by order dated 15.3.2017 passed in Cr. Misc. No.11421 of 2017. It is a case of misuse of privilege of bail. Earlier prayer of bail was rejected with an observation that the petitioner may renew his prayer for bail after framing of charge and the same has been framed on 20th May, 2016 and a copy of the framing of charge is annexed with this application.

Having considered the said facts and circumstances,

Patna High Court Cr.Misc. No.29248 of 2017 (2) dt.05-07-2017 2/2 the petitioner, namely, Jugesh Mandal @ Jugeshwar Mandl @ Jugaba Mandal is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Lakhisarai in connection with Rail Thana (G.R.P.) Jamalpur Case No.36 of 2008 with a condition that the petitioner shall represent physically before the trial court on each and every date. On failure to appear on two consecutive dates without any reasonable cause, his bail bonds shall liable to be cancelled.
