Mr. Sanjay Kumar Tiwary, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-05-2021 Heard Mr. Jyoti Ranjan Jha, the learned Advocate for the petitioners and Mr. Sanjay Kumar Tiwary, the learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Gangta P.S. Case No. 67 of 2020, dated 16.06.2020, instituted for the offences under Sections 304(B) and 302/34 of the Indian Penal Code.

The petitioners are the parents-in-law of the

Patna High Court CR. MISC. No.37518 of 2020(3) dt.26-05-2021 2/3 deceased. The husband of the deceased is in custody. The marriage between the son of the petitioners and the deceased had taken place about eight years ago. The learned counsel for the petitioners, on perusal of the police papers, has submitted that there is no witness who has spoken about the participation of the petitioners in the occurrence. It has further been submitted that the cause of death is otherwise but taking advantage of the death, the entire family members of the husband of the deceased including the petitioners have been made accused in this case.

The petitioners are septuagenarians and there is no specific allegation in the F.I.R. or in the police papers against them of demanding any dowry.

Regard being had to the facts afore-stated, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount

Patna High Court CR. MISC. No.37518 of 2020(3) dt.26-05-2021 3/3 each to the satisfaction of learned Judicial Magistrate-Ist Class, Munger in connection with Gangta P.S. Case No. 67 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
