2. The petitioner is in custody since 17.09.2016 in connection with Special Case No. 67 of 2016 arising out of Economic Offence P.S. Case No. 12 of 2016 for the offences alleged under Sections 8, 20(b)(ii)(c), 25 and 29 of the Narcotic Drugs and Psychotropic Substances Act and Sections 420, 467, 468 and 471 of the Indian Penal Code.

3. It is submitted that the petitioner has been falsely implicated merely because he happened to be the driver of Bolero vehicle from which the recovery of offending goods was made. It is submitted that the petitioner had no knowledge about the goods and admittedly he is not the owner of the vehicle. The petitioner claims clean antecedents.

4. Mr. V.N.P. Singh, learned senior counsel appearing on behalf of the Economic Offence Unit, opposes the bail petition submitting that the recovery of huge amount of about 182 Kg of

Patna High Court Cr.Misc. No.33206 of 2017 (3) dt.21-08-2017 2/2 Ganja has been made from the vehicle of which the petitioner was the driver.

5. Having regard to the nature of accusations and gravity of offence alleged as well as huge quantity of Ganja said to have been recovered from Bolero vehicle which was being driven by the petitioner, this Court is not inclined to grant the privilege of bail to the petitioner.
