This application for grant of anticipatory bail arises out of Tajpur P.S. Case No. 419 of 2018, disclosing offence under Section 304B, 201, 34 of the Indian Penal Code. The petitioner is uncle of the husband of the deceased. By an order dated 25.06.2019, while calling for case diary, the petitioner was granted provisional anticipatory bail. Case diary is available on record.

Learned counsel appearing on behalf of the petitioner has submitted that the petitioner lives separately with the in laws of the deceased and he has been implicated only because of his relationship with the husband of the deceased.

Patna High Court CR. MISC. No.38020 of 2019(5) dt.12-06-2020 2/2 Considering the materials available in the case diary, I find substance in the submission made on behalf of the petitioner, for the purpose of the present application for grant of anticipatory bail. This application is accordingly allowed to the provisional bail granted to the petitioner stands confirmed. Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st, Samastipur, District Samastipur in connection with Tajpur P.S. Case No. 419 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
