ANJANA MISHRA ORAL ORDER 04-11-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends arrest in a case registered for the offences punishable under sections 414 of the Indian Penal Code and section 27(b)(II) 27(d) of the Drugs and Cosmetics Act.

Case diary in the present case was called for which has since been received.

Learned counsel for the petitioner submits that so far as motor cycle is concerned, it belongs to him and the allegation of carrying illegal drugs thereon is a matter which can be verified subsequently as there is no verification report on record.

Patna High Court Cr.Misc. No.32588 of 2015 (3) dt.04-11-2015 Considering the aforementioned facts and circumstances of the case and that there is no cogent material in the case diary to implicate the petitioner, the petitioner, above named, in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri A. K. Srivastava, Judicial Magistrate, 1st Class, Raxaul, Motihari in connection with Chhauradano P.S. Case No 18 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973.
