Earlier, the prayer for bail of the petitioner was rejected by this Court vide order dated 08.12.2015 passed in Cr. Misc. No. 51803 of 2015 and one analogous case giving direction to the trial court to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably, within six months from the date of receipt of the record in Sessions Court but the impugned order goes to show that charge against the petitioner was framed on 29.02.2016 and in spite of issuance of non bailable warrant of arrest against the prosecution witnesses, not a single prosecution witness could be examined. However, learned counsel for the petitioner submitted that having similar allegation, co-accused Shiya Sharan Paswan and two others have already

Patna High Court Cr.Misc. No.38169 of 2016 (2) dt.28-09-2016 2/2 been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 01.12.2015 passed in Cr. Misc. No.45320 of 2015.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IV, Gaya in connection with Belaganj P.S.Case No. 52 of 2015.
