The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 385/353 of the Indian Penal Code and sections 145/146/147/174 of the Railway Act, 1989.

As per prosecution, it is a case of giving threatening to blow up to the railway station and on labour day while the train is running and also said to stop the train otherwise we will blast the station which has been communicated to section controller, Danapur.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner.

Patna High Court CR. MISC. No.41332 of 2022(3) dt.13-02-2023 2/2 Petitioner has not been arrested on the spot. Petitioner has one criminal antecedent vide Laxmipur (Gidaur) P.S. Case No. 289/2021 in which he is on bail. Petitioner is in custody since 01.11.2021.

Learned APP appearing for the State has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Rail Jhajha P.S. Case No. 79/2021, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Kiul.
