2. The petitioner has preferred this application for grant of anticipatory bail in connection with Kotwali P.S. Case No. 445 of 2022 dated 09.08.2022, registered for the offences punishable u/s 308, 379, 467, 468, and 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and the co-accused person along with 3 to 4 unknown persons are alleged to have started changing physical feature of the rented shop. On being objected by the informant, the petitioner and the co-accused persons started assaulting the informant. The petitioner snatched Rs. One lakh and golden locket with

Patna High Court CR. MISC. No.49031 of 2023(5) dt.19-02-2024 2/3 diamond worth Rs. 1,50,000/- of the informant. Further the petitioner made allegation that the informant took Rs. 60 Lakhs from the petitioner for registry of the said shop but the informant did not register.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is no specific allegation allegation against the petitioner. From the perusal of F.I.R. it is clear that the date of occurrence is 09.03.2022 but the F.I.R. lodged on 13.04.2022 after delay of one month. The petitioner has clean antecedent as stated in para 3 of the bail petition.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case and the nature of allegation against the petitioner, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna in connection with Kotwali P.S. Case No. 445 of 2022, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
