The petitioner is seeking anticipatory bail in connection with Banka (Barahat) P.S. Case No. 638/2017 registered under Sections 363/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case of old land dispute, and on mere suspicion, till date nothing has been brought on record to show even prima facie material connecting the petitioner with the present case, and after noticing the fact that the Investigating Officer had not been able to collect any material showing the hands of the petitioner, Sudeen Pandit and Kanchan Pandit, who are the co-accused, they have been granted privilege of anticipatory bail by learned coordinate
Patna High Court CR. MISC. No.38787 of 2019(4) dt.20-09-2019 2/2 Bench of this court in Cr. Misc. No. 8656/2019. Neither learned A.P.P. for the State has appeared nor any other material has been brought to the notice of this court to draw a distinction between the case of the co-accused who have been granted privilege of anticipatory bail with that of the case of the present petitioner.
In the facts and circumstances of the case, in the event of his arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Banka (Barahat) P.S. Case No. 638/2017, subject to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
