The petitioner is in custody since 25.03.2018 in connection with Kutumba P.S. Case No. 65 of 2010 for the offence registered under Sections 302, 379/34 f the Indian Penal Code.

Learned counsel for the petitioner submits that he is not named in the first information report but merely on the basis of confessional statement of co-accused made before the police, which has no evidentiary value, the petitioner is languishing in jail. It is further submitted there is no recovery from the possession of the petitioner.

Considering the aforesaid facts and circumstances of the

Patna High Court Cr.Misc. No.43359 of 2018 (3) dt.01-08-2018 case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Kutumba P.S. Case No. 65 of 2010.
