The petitioner apprehends his arrest in connection with Digha P.S. case no. 233 of 2014 registered under Sections 341,323,307,379 and 504/34 of the IPC.

Both the parties seem to be the neighbours.

As per prosecution case the petitioner is said to have assaulted the informant on the head with iron rod causing a simple injury. Injury report has been appended to the anticipatory bail application. Same day the father of the petitioner filed a case against the present prosecution side alleging assault on the head of the father of the petitioner.

Considering the circumstances under which the occurrence appears to have been committed as also the fact that there is a counter version and the father of the petitioner received injury as also the fact that the petitioner has no criminal

Patna High Court Cr.Misc. No.42126 of 2014 (3) dt.24-06-2015 2/2 antecedent, I am inclined to privilege him with anticipatory bail. In the facts and circumstances of the case, let the petitioner, named above, in the event of his arrest/surrender before the learned Court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in connection with Digha P.S. case no.233/2014, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. with following conditions:- (i) One of the bailors shall be the own/close family member of the petitioner.

(ii) As soon as the charges are framed the petitioner shall appear in person before the trial court on the date(s) fixed at the trial. In case of default in such appearance on two consecutive dates, the trial Court shall have liberty to cancel the bail bonds of the petitioner and secure his arrest in accordance with law.
