The petitioner, who is in custody, seeks bail in connection with Dalsingsarai P.S. Case No. 63 of 2016 registered for offence under Section 379 of the Indian Penal Code. Allegation in brief is that the informant was going to deposit Rs. 2,75,450/- in the HDFC Bank. He was going on motorcycle as a pillion rider. Three persons came behind from the motorcycle hitting their motorcycle and took away the bag containing the aforesaid amount.
Learned counsel for the petitioner submits that FIR is against unknown. This petitioner was arrested in another case and on the basis of confessional statement he was implicated in this case. Besides confessional statement there is no other material
Patna High Court Cr.Misc. No.608 of 2017 (2) dt.11-01-2017 against this petitioner. Neither any looted money was recovered from his possession nor he was put on T.I. Parade. Charge sheet has been submitted in this case.
Considering the aforementioned facts and circumstances of the case that except confessional statement there is no material against the petitioner, named above, he is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned A.C.J.M, Dalsingsarai (Samastipur) in connection with Dalsingsarai P.S. Case No. 63 of 2016.
