JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 21-06-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor representing the State. Regard being had to this Court's order, dated 22.03.2017, wherein the Court had indicated that if the petitioners agreed to deposit some substantial amount for the welfare of the juveniles in the State of Bihar, this Court may consider their second application for grant of anticipatory bail.
Learned Counsel for the petitioners has submitted that petitioners cannot afford much and they can
Patna High Court Cr.Misc. No.12912 of 2017 (3) dt.21-06-2017 2/3 not pay more than Rs. 10,000/- for the welfare of the juveniles in the State of Bihar.
Accordingly, the petitioners are directed to deposit the said amount of Rs. 10,000/-, in the Court of Juvenile Justice Board, Vaishali, at Hajipur, to be spent for the welfare of the children living in the Observation Home, Hajipur, in a manner as can be decided by the Juvenile Justice Board, Vaishali, at Hajipur.
The said amount must be deposited within a period of one month from today and a receipt showing deposit of the said amount be produced before the Court of learned Sub Divisional Judicial Magistrate, Vaishali, at Hajipur.
Considering the facts and circumstances, this application is allowed.
Let the petitioners, Suman Kumar Singh, Dharmshila Devi and Laxami Devi @ Laxmi Singh, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Vaishali, at Hajipur, in connection with Complaint Case No. 2255 of 2011, subject to the condition laid down under Section 438

(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Court, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
