1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 137(2), 87, 352 and 3(5) of the B.N.S. and Section 8 of the POCSO Act.

3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that the accused persons including the petitioner kidnapped her minor daughter.

4. The learned counsel for the petitioner submits that parents of the petitioner Ramjit Ram and Rekha Devi had approached this Court seeking anticipatory bail by filing Cr. Misc. No.19171 of 2026 and the same came to be allowed by an

Patna High Court CR. MISC. No.41729 of 2026(2) dt.24-07-2026 2/2 order dated 16.04.2026, since the victim had not supported the case of the prosecution under Section 183 B.N.S.S. It is further submitted that petitioner and the victim were in love and they performed their marriage.

5. Learned A.P.P. opposes the anticipatory bail application.

6. Considering the submissions made by the learned counsel for the petitioner and taking into consideration the order dated 16.04.2026 in Cr. Misc. No.19171 of 2026, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor Court in connection with Nawalpur P. S. Case No.171 of 2025, subject to the conditions laid down under Section 482(2) of the B.N.S.S.

7. The application stands allowed.
