The petitioner no.2, namely, Chitranjan Choubey is facing accusation punishable under Sections 420 and 409 of the IPC vide Kudra P.S. case no. 189 of 2014.

The prosecution case in brief is that petitioner being the office bearer of PACS has procured the paddy from the farmers for which the payments were made but on enquiry it was found that the paddy was not actually procured and forge document was created and the payment thereagainst were also not made to the farmers. In such manner, an amount of Rs. 2,21,000,00 ( Two Crores Twenty Lack) was misappropriated. A detailed enquiry was made before lodging the case.

Patna High Court Cr.Misc. No.46651 of 2014 (4) dt.24-06-2015 2/2 Learned APP, on the other hand, has pointed out before this Court the manner in which the occurrence was committed.

Considering the allegations attributed to the petitioner and the amount of misappropriation of the government money made by the petitioner in connivance with the other accuseds, in my view, he does not deserves anticipatory bail. Prayer for bail made on behalf of the petitioner no.2 is rejected. (Kishore Kumar Mandal, J) Shyam/- U T
