Petitioner prays for bail in connection with Industrial P.S.Case No. 132 of 2017 registered for the offence punishable under Section 392 of the Indian Penal Code.

Allegation as per FIR is of snatching of motorcycle, ATM cards and Mobile phone. Petitioner is not named in the FIR and later on his name transpires on the basis of recovery of looted mobile.

Submission of learned counsel for the petitioner is that on CDR location it was found that the mobile was used by one Md. Tausif, who disclosed the name of one Md. Talif Alam and the said Talif Alam disclosed the name of the petitioner and petitioner is in custody since 19.4.2018, having no criminal antecedent.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Industrial P.S.Case No. 132 of 2017, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
