JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2017 The petitioner seeks regular bail in connection with Barauni P.S. Case No. 437 of 2016, registered for offences punishable under Section 413, 414/34 of the Indian Penal Code. From perusal of record, it appears that earlier also the petitioner has moved this court for grant of regular bail, which was rejected vide order dated 21.02.2017 vide order dated 7086 of 2017, with observation that petitioner may renew his prayer for bail after framing of charge.
It has been submitted by learned counsel for the petitioner that uptil now the charge could not be framed in this case as the presiding officer is on long leave and as such he has renewed the prayer for bail as the petitioner has been in judicial custody for last six months.

Having heard both sides, in view of the observation made in the order dated 21.02.2017, I am not inclined to release the petitioner on regular bail, at least at this stage. However, District Judge, Begusarai is directed to see that in this case charge is framed within a period of one month from today and once the charge is framed, as stated in the order dated 21.02.2017, petitioner will be at liberty to renew his prayer for bail in the court concerned itself, which will be considered by the concerned court in view of the earlier order passed by this Court. With the above observation, this application is disposed of.
