JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-06-2019 This is an application for grant of anticipatory bail in connection with Belaganj P.S. Case No. 12 of 2019, disclosing offences under Sections 341, 342, 385, 387, 34 of IPC and Section 27 of the Arms Act.

Allegation as per complaint petition is that petitioner and informant is Proprietor of Best Lead Trading Company Pvt. Ltd.. It has been stated that petitioner with his rifle, Subodh Singh and Mritunjay Singh with pistols, Subodh Singh a gallon of diesel and 3-4 unknown persons with arms started firing and ordered to open fire and to put Poplin machine on fire upon that, accused persons fired in the air and demanded a sum of Rs.200 per truck as levy and thereafter, they fled away from there. Petitioner has three other cases also.

Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.39471 of 2019(2) dt.27-06-2019 2/2 that he has falsely been implicated in this case. There is no transaction of money and there is no allegation of assault against him.

Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, the same shall be considered by the learned court below on its own merit.
