The petitioner, who is father-in-law of the deceased, is languishing in jail since 29.03.2017 in a case registered for the offences punishable under Sections 304 (B), 201/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. The prosecution case as lodged by the informant is that his sister Rita Devi was married with one Sanjay Yadav on 28.04.2016 and due to non fulfillment of demand of dowry, she has been killed and her dead body was made to disappear. It has been submitted by the learned counsel for the petitioner that he is innocent and only general and omnibus allegations have been leveled against the petitioner and that charge sheet has already been submitted, hence, there is no chance of

However, learned A.P.P. for the State opposes the prayer for bail stating that the informant's sister was done to death within a year of her marriage, hence, opposes the prayer for bail. Considering the facts and circumstances of the case and materials on record and the husband of the deceased is in custody and the petitioner is father-in-law, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- ( Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- III, Danapur, Patna in connection with Dulhin Bazar P.S.Case No. 114 of 2016, subject to the conditions that the petitioner will appear before the learned Court below on each and every date during trial and failure to appear before the Court below on three consecutive dates without assigning any reason will entail cancellation of his bail bonds.
