01-12-2016 Heard Sri Sanjay Kumar Sharma, learned counsel for the petitioner and Sri Madan Kumar, learned Addl. Public Prosecutor.
The sole petitioner, who is in custody since 10-05-2016 in Tarabari P.S. Case No. 34 of 2016, corresponding to Special Case No. 17 of 2016, registered for offence under Sections 20, 22, 23 and 24 of the Narcotic Drugs & Psychotropic Substances Act, 1985 (for short "NDPS Act"), has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that petitioner was simply a passenger on a Scorpio, from which, allegedly 30 Kg. of Ganja was recovered.
However, after going through the material on record,
Patna High Court Cr.Misc. No.40433 of 2016 (3) dt.01-12-2016 2/2 the Court is of the opinion that considering the restriction under Section 37 of the NDPS Act, it would be difficult to extend the privilege of bail.
The petition stands dismissed.
