Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 63 and 65 of the Copyright Act and Sections 103 and 104 of the Trade Mark Act, registered in connection with Shikarpur P.S.Case No. 701 of 2020. As per allegation, the informant, who is Manger of Tact India Company, got an information that some fake products of Castrol Company, which has executed power of attorney in favour of the informant, were sold by the co-accused Ranjan Kumar and the present petitioner. On raid, some fake products were recovered form their shops.

The learned counsel for the petitioner has submitted that earlier there was agreement between the informant and the petitioner, but the agreement was rescinded. He has submitted further that the petitioner was cheated himself as the supplier of the informant had supplied fake products to the petitioner. On

Patna High Court CR. MISC. No.51748 of 2021(3) dt.11-10-2022 2/2 similar footing co-accused Ranjan Kumar has been granted anticipatory bail by this Court in Cr. Misc.No. 568 of 2022. Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Shikarpur P.S.Case No. 701 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
