This application is for grant of bail in connection with Ahiyapur P.S.Case No.118/15 for the offence under Sections 506, 302/34 of the Indian Penal Code.
It is submitted on behalf of the petitioner that there is allegation that the petitioner caught the child and got him fell down on the floor due to which he received injury but the allegation has been made against the petitioner due to dispute from before. The petitioner is in custody for about six months. Heard learned A.P.P. also, who has opposed the prayer for bail.
Having heard both sides. In view of the fact that there is direct allegation against this petitioner that he has thrown the boy
Patna High Court Cr.Misc. No.54632 of 2016 (3) dt.16-02-2017 2/2 on the floor, due to which he received injury as such, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months and if not concluded, the petitioner is at liberty to renew his prayer before the court concerned itself and the learned court below will pass appropriate order without being prejudiced by the order of this Court. With the aforesaid observation, this application is dismissed.
