Both the applications arise out of same P. S. i.e.
Patna High Court CR. MISC. No.37373 of 2019(2) dt.20-06-2019 2/3 Punpun P.S. case no. 117 of 2019, and as such, they are heard together and are being disposed of by this common order. The petitioners seek bail in connection with Punpun P.S. case no. 117 of 2019, Special case no. 4013 of 2019 instituted for the offence under Section(s) 30(a) of Bihar Prohibition & Excise Act, 2016.
It is alleged in the written report that petitioners along with three other ladies as named in the written report were apprehended by police. It is further alleged that 12 litres of illicit liquor has been recovered from possession of each ladies. Petitioners are in custody since 22.4.2019.
Considering the aforesaid, let the petitioners of both cases, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise Act), Patna in connection with Punpun P.S. case no. 117 of 2019, Special case no. 4013 of 2019, subject to the condition that both the bailors shall be the close relative of the petitioners. It is mentioned in Para 3 of bail petition that petitioner of Cr. Misc. no. 37373 of 2019 is accused in another case under the Excise Act.
The petitioner of Cr. Misc. no. 37373 of 2019 will file
Patna High Court CR. MISC. No.37373 of 2019(2) dt.20-06-2019 3/3 affidavit at the time of filing bail bond that she would not indulge herself in such type of activities in future. If she is found indulged in such type of activities, her bail bond in instant case will liable to be cancelled.
