JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a, 26, 35 of the Arms Act.
One country made katta, one live cartridge as well as some materials which are used in preparation of bomb are said to have been recovered from possession of the petitioner for which petitioner is in jail custody since 21.10.2014. Learned counsel appearing for the petitioner submits that the present case has been lodged only for the offences of Arms Act and a separate case has been lodged for recovery of explosive substance. It is further submitted that moreover, having more or less similar allegation, one co-accused, Dilip
Patna High Court Cr.Misc. No.45502 of 2016 (2) dt.19-10-2016 2/2 Singh @ Dilip Kumar Singh has already been granted privilege of bail.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Bhagwanpur P.S. Case No. 226 of 2014.
