The petitioners seeks bail in Kawakole P.S. Case No. 16 of 2017 registered for the offence punishable under Sections 341, 323, 324, 307/34 of the Indian Penal Code. Allegation against the petitioner no. 1 is of causing assault on informant by wood and there is no specific allegation against petitioner no. 2 of any assault.

It has been submitted on behalf of the petitioners that petitioners have got no criminal antecedent. It has been further submitted that similarly situated co-accused person on whom there is allegation of assault by Tangi has been granted bail by a co-ordinate bench of this Court vide order dated 14.08.2018 in

Patna High Court Cr.Misc. No.42290 of 2018(4) dt.20-08-2018 2/2 Criminal Miscellaneous No. 47384 of 2018. Petitioners are custody since 09.05.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Nawada, in connection with Kawakole P.S. Case No. 16 of 2017.
