The petitioner seeks bail in a case instituted under Section 395 of the Indian Penal Code.

The allegation is that six unknown miscreants forcibly entered into the house of the informant and on the point of pistol, looted several household articles and jwelleries from the house of the informant.

It has been submitted on behalf of the petitioner that the he has falsely been implicated in the present case. He is in custody since 20.04.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the

Patna High Court Cr.Misc. No.51011 of 2016 (2) dt.28-11-2016 2/2 F.I.R. Subsequently, in course of investigation, the informant has raised suspicion against the petitioner. There is no recovery of any incriminating article from the possession of the petitioner. The other co-accused has been granted bail by this court vide Cr. Misc. No. 29350 of 2016. It is further submitted that the petitioner may be released on bail after completion of one year in custody i.e. from 20.04.2016.

On behalf of the state, it has been submitted that the petitioner has been named in the F.I.R. in course of investigation and he has got as many as ten cases of a similar nature. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail after completion of one year in custody i.e. from 20.04.2016 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Civil Lines P.S. Case No. 92 of 2016.
