2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Atri P.S. Case no. 66 of 2024 instituted for the offence under Sections 304(B), 201/34 of the Indian Penal Code.
3. It is a case of dowry death. As per allegation in the FIR, informant's daughter was married to brother of the petitioner in the year 2018 and due to non-fulfillment, she was done to death by putting her on fire. Without furnishing information about her death to her naihar, all FIR named accused persons with a view to wipe off the evidence, disposed of her dead body.
Patna High Court CR. MISC. No.39096 of 2025(2) dt.04-07-2025 2/3 Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Petitioner is unmarried sister-in-law of the deceased, she has no concern with the offence. Deceased and her husband were living separately from the joint family house since long and petitioner has no concern with the family affair of the deceased. Husband of the deceased is already in judicial custody. Similarly situated other accused persons have already been enlarged on bail by another coordinate Bench of this Court vide order dated 19.3.2025 passed in Cr. Misc. No. 16937 of 2025 and vide order dated 25.11.2024 passed in Cr. Misc. No. 76036 of 2024.
Learned APP appearing for the State has opposed the prayer of Bail.
Having heard learned counsel for the parties and considering the fact that several other accused persons have already been enlarged on bail, this Court is also inclined to enlarge the petitioner on bail, who is unmarried sister-in-law of the deceased. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Atri P.S. Case no. 66 of 2024, he will be enlarged on bail on furnishing bail bond
Patna High Court CR. MISC. No.39096 of 2025(2) dt.04-07-2025 3/3 of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gaya subject to the conditions as laid down under section 482 of the BNSS.
