2. The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 324, 307, 504/34 of the Indian Penal Code.
3. As per the prosecution case, all the F.I.R. named accused persons including this petitioner, variously armed, abused the informant and on the order of co-accused Narendra Puri, co-accused Nirbhay Puri assaulted on the head of informant with sword and other co-accused assaulted him with pipe, due to which, he sustained injury. It is further alleged that when wife and daughter of informant came to save informant,
Patna High Court CR. MISC. No.39052 of 2025(2) dt.24-07-2025 2/3 they were also assaulted by co-accused Nirbhay Puri and other co-accused persons.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case due to previous enmity. As per F.I.R. itself, specific accusation of assault is against co-accused Nirbhay Puri. So far as this petitioner is concerned, there is general and omnibus allegation and no specific allegation of overt act has been alleged against him. Similarly situated co-accused namely Narendra Puri has been granted anticipatory bail by a coordinate Bench of this Court, vide order dated 18.11.2024 passed in Cr.Misc. No. 75414 of 2024. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Gopalganj in connection with Hathua P.S. Case No. 289 of 2023, subject to condition as laid down under Section 438(2) of
