Hence, in the interest of the parties, the entire proceeding as against all the accused persons including the order of cognizance dated 14.02.2013 passed by the Judicial Magistrate, 1st Class, Patna Sadar, Patna in Complaint Case No. 2999(C) of 2012 is, hereby, set aside.

The Complainant is at liberty to withdraw Rs. 59,000,00/- (Fifty Nine Lakhs) deposited by the Petitioner on orders of this Court in view of the agreement. The Court below is hence directed to release the pass-book which has been deposited by him in which Rs. 59,000,00/- have been deposited by the Petitioner so as to enable him to avail benefit of the same.

The Application stands disposed off with the aforesaid observations.
