The petitioners seek bail in Ara Town P.S. Case No. 61 of 2018 instituted for the offence under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioners submits that in the written report there is no allegation of any specific overt act against the petitioners. The specific allegation of causing firearm injury is against Prahlad Yadav.
Petitioner is said to be in custody since 09.03.2018. It is mentioned in paragraph-3 of the bail petition that petitioners have no criminal antecedent.
Considering the aforesaid facts and circumstances of
Patna High Court Cr.Misc. No.41730 of 2018 (3) dt.24-09-2018 2/2 the case, prayer for bail of the petitioners is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara, in connection with Ara Town P.S. Case No. 61 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioners.
