The petitioner is seeking bail in Nagar (Nawada) P.S. Case No. 200 of 2017 registered under Sections 147, 148, 149, 341, 323, 307, 353, 188, 283, 337, 153-A and 427 of the Indian Penal Code, Section 27 of the Arms Act and Sections 3 / 4 of the Explosive Substance Act.
Learned counsel for the petitioner submits that a bare perusal of the First Information Report would show that on the occasion of the religious ceremony persons of two communities indulged in free-fight. Some of the persons were arrested by police while maintaining law and order in the alleged place of occurrence. He further submits that similarly situated co-accused
Patna High Court Cr.Misc. No.25648 of 2017 (2) dt.13-06-2017 2/2 has been granted regular bail in Cr. Misc. No. 25354/2017. The petitioner has no criminal antecedent.
Learned A.P.P. has opposed the prayer for bail. Considering the nature of allegations as also the fact that a co-accused has been granted regular bail, let the petitioner, namely, Pankaj Kumar be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in Nagar (Nawada) P.S. Case No. 200 of 2017.
