JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-09-2018 The petitioner is in custody since 11.7.2014 in connection with Sessions Trial No.839 of 2014 arising out of Dharhara P.S. Case No.81 of 2014, registered for offences punishable under Sections 302, 201/34 of the Indian Penal Code. Earlier prayer for bail of the petitioner was twice rejected by this Court vide order dated 20.5.2016 passed in Cr. Misc. No.15579 of 2016 and order dated 2.8.2017 passed in Cr. Misc. No.33030 of 2017.

Submission of learned counsel for the petitioner is that he is in custody for four years and up till now two witnesses have been examined in this case and there is no substantial progress of the trial.

Heard learned A.P.P. also.

In view of the aforementioned facts and circumstances

Patna High Court Cr.Misc. No.45850 of 2018 (3) dt.12-09-2018 2/2 and considering the petitioner is in custody for more than four years, as such, learned trial court is directed to expedite the trial and try to conclude it within a period of seven months by conducting it on regular basis. However, if the trial is not concluded within the aforesaid period and no latches on the part of the accused, the learned court below shall release the petitioner to his own satisfaction.

With the aforesaid observation, this application is disposed of.
