JUSTICE SUDHIR SINGH ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 406 and 420/34 of the Indian Penal Code. Allegation against petitioner is that he took money from informant on the pretext that he would go to abroad and return th money from there. But neither he had gone abroad nor return the money and thus, cheated informant.
It has been submitted on behalf of petitioner that he is in custody since 1.10.2016. He has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. He has been made accused due to mistake of fact. The main allegation is against Md. Ashraf in whose account the entire money is said to have been deposited. It is further submitted that petitioner is ready to deposit a sum of Rs.30,000/- in the court below which shall be released in favour of informant. On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Patna High Court Cr.Misc. No.51121 of 2016 (3) dt.08-12-2016 2/2 Considering the aforesaid facts and circumstances, it is directed that petitioner shall deposit a sum of Rs.30,000/- in the court below which shall be released in favour of informant. Let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram, Rohtas, in connection with Sasaram Tilauthu P.S. Case no. 783 of 2016.
