ANJANA MISHRA ORAL ORDER 23-08-2018 Heard the learned counsel for the petitioner and counsel appearing on behalf of the State.

The petitioners are in custody since 17.05.2018 in connection with Teghra P.S. Case No.190 of 2016, registered under Sections 147, 148, 149, 447, 341, 342, 323, 324, 302, 504, 506 of the Indian Penal Code.

Learned counsel for the petitioner submits that earlier he had been extended the privilege of bail but due to cancellation of pairvi, the bail bond of the petitioner was cancelled. He further submits that the petitioner is willing to abide to any terms and conditions imposed upon him and shall not further mis-use the privilege of bail. In view of the aforementioned undertaken given by the petitioner that he was earlier on bail, both the petitioners, above

Patna High Court Cr.Misc. No.47077 of 2018 (3) dt.23-08-2018 2/2 named, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Begusarai, in connection with Teghra P.S. Case No.190 of 2016 on the condition that :-

(1) One of the bailors will be his own blood relative, preferably, father, mother, brother, sister and/or their wife.

(2) The petitioner shall not indulge himself in any similar offence till conclusion of the trial.

(3) The petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.

(4) The petitioner shall co-operate with the investigation, if not already concluded, and make himself available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail.
