JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. After some argument, learned counsel for the petitioner seeks permission for withdrawal of this petition with liberty to file appeal in accordance with new amended Act of S.C./S.T. (Prevention of Atrocities) Act.

With the aforesaid liberty, this petition filed in connection with POCSO Case No. 05 of 2014 arising out of Wazirganj P.S. Case No. 113 of 2014 stands dismissed as withdrawn.

However, petitioner may utilize certified copy of F.I.R. as well as impugned order and if he makes any prayer before the Registry, the Registry shall return certified copy of F.I.R. as well

Patna High Court Cr.Misc. No.51263 of 2016 (2) dt.07-12-2016 2/2 as impugned order after getting substituted photocopies of those documents.
