Petitioner prays for bail in connection with Sherghati P.S.Case No. 27 of 2012, G.R.No. 125 of 2012, registered for the offences punishable under Sections 304B/34 of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act. Allegation against the petitioner, who happens to be husband of the deceased, is of killing his wife due to demand of dowry.

Submission of learned counsel for the petitioner is that he was not present at the time of occurrence and he has falsely been implicated in this case and he is in custody for about nine months. Heard learned APP also.

Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner.
