JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-07-2015 The petitioner is apprehending his arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 323, 354, 379, 448, 504 of the Indian Penal Code. It is alleged against the petitioner that petitioner entered into the house of the complainant, outraged the modesty of the complainant and snatched silver chain. It is further alleged that petitioner earlier also committed indecent behaviour with the sister-in-law of the complainant Rekha Devi who had thrown hot vegetables on his face causing injuries. It is submitted by learned counsel for the petitioner that due to the dispute with the sister-in-law of the complainant the present case has been lodged when for the occurrence of 04.10.2014 the complaint has been filed on 08.10.2014.
A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.30394 of 2015 (2) dt.30-07-2015 2/2 petition that petitioner has no criminal antecedent. The delayed lodging of the complaint constitutes ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Complaint Case No. 2995C of 2014, pending in the Court of learned Judicial Magistrate, 1st Class, Araria. Accordingly the application is disposed off.
