JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-05-2017 No one appears on behalf of the petitioner on repeated call. Learned Additional Public Prosecutor is present. The learned In-charge Additional Sessions Judge-V, Munger has reported vide his letter no. 72 dated 03.04.2017 that jail authorities took several steps to get the eyes of petitioner operated but due to increase of blood sugar level, the operation of eyes of the petitioner could not be performed. However, it has also been reported that argument in this case has already commenced but due to his joining as Additional Sessions Judge-I, Munger, the court of Additional Sessions Judge-V, Munger is lying vacant. Considering the aforesaid facts and circumstances, I do not feel it proper to release the petitioner on bail and hence, his prayer for bail in connection with Sessions Trial No. 908 of 2014

Patna High Court Cr.Misc. No.37599 of 2016 (4) dt.03-05-2017 2/2 arising out of Kasim Bazar P.S. Case No. 115 of 2014 is again rejected.

However, learned Sessions Judge, Munger is directed to ensure the transfer of Sessions Trial No. 908 of 2014 arising out of Kasim Bazar P.S. Case No. 115 of 2014 pending in the court of Additional Sessions Judge-V to a running court within a week from the date of receipt/production of copy of this order and after transfer of the aforesaid record the concerned court must dispose of above stated case within a month from the date of receipt of aforesaid record in his court, if the trial of the petitioner is not stayed by a competent court.
